Unearth Education (“Unearth Education”, “we”, “us”, or “our”) understands that it is important for visitors to our website (the “Site”) and customers of our subscription management, learning management and billing services (together with the Site, the “Services”) (visitors and customers, each, are “you” or “your”) to know how your personal information is used and shared. We recognize our obligation to keep your information secure and confidential. In using the Services, Unearth Education may collect data from you, including personally identifiable information (“Personal Data”), about you and your customers (collectively, the “Data”). This Privacy Policy (the “Policy”) describes what Data we collect, how we use the Data, and additional policies with regard to the Data. This Policy does not cover third-party services over which we do not have control.
We abide by all laws, rules and regulations as outlined by the country of Canada.
We may modify this Policy at any time. We will notify you via email and post on the Site of such modification.
By visiting or using the Services in any manner, you acknowledge that you accept this Policy and you give your consent that we will collect, use, and share your Data as outlined in this Policy.
Data You Provide
Depending on your use of the Services, you may be asked to provide the name, address, phone number, email address, country of residence, credit card or bank information, or other Personal Data of yourself or your customers. Any Data requested may be necessary to provide the Services which you request. You may always refuse to provide this Data, but this may lead to our inability to provide you with some Services.

What Information Do We Collect?
We collect information both directly from you and automatically when you visit our Site or use the Service.
Information We Collect
UEÉ offers virtual and in-person programs and certifications with varying enrollment processes, levels of accessibility and data collection to suit the unique needs of school boards.
Teacher Information. When a teacher registers for UEÉ certifications and programs, we collect certain personal information such as a full name and email. We may also collect additional information about the School, such as a school or district identifier, student grade, program, information about teachers and others authorized to use the Service, and payment information.
Student Information. Once registered, and dependent on the certification or program selected, the School may provide, or permit UEÉ to collect, information about its students authorized to use the Service, such as a full name and email. (all personally identifiable information collected from or about students is referred to as “Student Data”). The School may elect to provide non-personally identifiable names and emails, at its discretion, or, may elect to not provide any Student Data at all.

Use of Data
We use the Data you provide to us for the following purposes: to provide access to the Unearth Education software, to provide Services and customer support at your request, to process your transactions and send notices about your transactions, to administer your account, to resolve disputes, to collect fees, to troubleshoot errors, and to meet legal requirements.
We use the Data we collect automatically, in aggregate and/or anonymized form, to improve Services.
Sharing Data
We do not sell or rent your Data in personally identifiable form to anyone.
Modification and Retention of Data
If you wish to update Data provided to us, you may do so through the Site or by contacting us at info@Uneartheducation.com.
We retain your Data for as long as the information is relevant to our business purposes or until you request that we remove the Data. However, we may be required by certain laws or regulations to retain your Data for as long as such laws and regulations require us to do so.
Customers who wish to have their Data deleted from the Services may do so by contacting us at info@UnearthEducation.com. Downgrading your Unearth Education account will also remove all of the Data of your customers from the Services. If you wish to remove the Data of your customers from the Services without downgrading your Unearth Education account, you may do so via the Unearth Education Custom Login. However, you are responsible for deleting your Data
There may be residual Data that will remain in our database logs and other records. Such residual Data will be deleted according to a fixed schedule.
Invitations by Registered Users
You can invite other people to become registered users of Unearth Education by sending an invitation email. For user verification and user volume purposes, we may store the email addresses that you provide to us though our automated invitation system. We do not sell these email addresses or use them to send any other communication.
E-mail Communications
– Transactional Emails
We may send transactional emails to you in order to provide support, invoices, bill reminders, or other notices as part of our Services. As a part of setting up and using the Services, we may also send emails to you about how to use our Services or how to enable or setup various features and functionality of the Services.
If you choose to use our SMTP provider to send transactional emails to your customers, we will send those emails to your customers on your behalf, as specified in the Customer Communications section of the Unearth Education Services dashboard.
If you subscribe to updates via our status page at status.Unearth Education, you will receive notifications relevant to the status of the Services. You may unsubscribe from these notifications at status.Unearth Education.
– Promotional Emails
With your consent, we may send promotional emails, including but not limited to: newsletters, information emails about our Services, or updates about new features offered in our Services. You may opt out of these communications at any time by clicking on the provided opt-out link in the email.
Privacy of Children
We encourage parents and guardians to be aware of and participate in their children’s online activities. We strictly adhere to the Children’s Online Privacy Protection Act and will not knowingly collect, use or disclose personal information from any child under the age of thirteen (18) in any manner that violates that law.
Unearth Education as a Data Processor
In our role as a service provider to you, we may collect, use, or disclose the Data of your customers. You are responsible for ensuring that the rights of your customers are protected. We will process Data in accordance with the terms of our agreement with you and your lawful instructions.
Links to External Websites
The Site may contain links to other sites on the Internet that are owned and operated by third parties. We are not responsible for the collection or use of your Data by any third-party sites. Therefore, Unearth Education disclaims any liability for any third party’s use of your Data obtained through your use of a third-party web site.
All App data is stored in our Canadian located cloud server. All information in encrypted within the cloud database so data cannot be viewed.

Security
We have policies and procedures in place to protect the privacy and confidentiality of your Data that we collect and maintain. All Data is stored on secure servers, behind a firewall, at a data center, with access to data strictly controlled. We use Secure Sockets Layers (SSL) to encrypt your user passwords and personal credit information, including your credit card information and expiration date, before it travels over the Internet. Any unauthorized use of the Services may result in criminal prosecution and/or civil claims.
Third-party educators/companies/subcontractors
We ensure any of our educational and technology partners are follow our strict security guidelines and they them self are vetted individuals with proven security track records. They are required to have the same or better security protocols in place
In case Unearth Education is sold
If Unearth Education is to be sold we ensure the company that will be taking over our platform follow the same security guidelines we do. We ensure the company has a proven track record of security and if they do not meet our security criteria we will not offer our platform to them.
Perception Web Management
Our developer and hosting partner has access to our system to ensure the system is secure and running correctly. Your Right to Access Data
You may have certain rights to access your Data stored in Unearth Education’s Services or shared by Unearth Education with third parties. Arbitration or Disputes
In the event of any dispute or claim arising between the client and UEÉ as to their respective rights and obligations under the Terms of Use, either party may give the other written notice of such dispute or claim. The notifications of dispute or claim shall be made within thirty-one (31) days of the dispute or cause of action arising. If the dispute or claim cannot be resolved through negotiation to the satisfaction of both parties, either of the parties may submit the particular matter to arbitration in accordance with the Arbitration Act of Ontario.
Breach Protocol
In the event of a breach, UEÉ will respond in the following
- Once we are notified of a breach all admin accounts are turned off and passwords changed
- If we cannot log in via our admin account, we can manually gain access with an update to the database. Should that fail, we can use a previous nightly backup to restore and gain access
- We review our platforms logs to see how the account was breach and if required review server logs for irregular activity
- We patch and correct the issue an ensure the system is stable
- We notify all affected users and relay the information that may have been breached.
Payment Terms
- Placing an Order. Certain aspects of the Service may be provided for a fee or other charge. You agree to our pricing, payment and purchase order terms which will be communicated upon registration. The company may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion. Any change to our pricing or payment terms shall be communicated with clients.
- Payment Methods. We accept email money transfers, direct deposits or cheques.
- Payment Information; Deposit and Taxes. All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. In some cases, a deposit is required. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.
LEARNING PLATFORM

The information provided explains the terms by which you may use the UEÉ learning platform.
Certain services may be subject to additional terms and conditions specified by us from time to time, and your use of such services is subject to those additional terms and conditions, which are hereby incorporated into these Terms by reference.
Unearth Education Learning Management System
- Is hosted in Canada with end-to-end encryption to ensure proper security,
- Requires an account with a username and password for access. This account is issued by UEÉ and requires a full name and email address.
- Users can only register themselves with the unique registration link that is created by UEÉ. This assists with putting controls in place to prevent uninvited guests from joining.
- Users are allowed to reset their passwords using our forgot password tool. An email is sent to the users email on file where they can reset their password. Passwords must follow our strict guidelines such as the user of capitals and special characters in the password
- Users can only access *events in which they are registered for,
- Has controls in place to grant permissions for users to share content,
- Has controls in place to monitor chat features,
- Never records when students are present,
- Deletes users accounts at the end of the school year, but retains user completion records for up to 10 years.*
- Maintains 100% privacy and does not collect or request any personal information (excluding full name and email address).
*We store student completion records for 10 years or less if requested for the information to be destroyed. Upon request and when ID has been vetted, we share the completion record with the student up to 10 years.
UEÉ ensures that all:
- *Events are hosted inside the online learning platform which cannot be accessed unless the user has a login created by UEÉ,
- Speakers, guests and workshop presenters can only view the users’ name during live events.
Terms for Access by Students/Children
UEÉ does not sell products through its Service to children, but only to adults, who can make a purchase using one of our payment methods. If you are under eighteen (18) years of age, you may use the Service only with the involvement and consent of a parent or legal guardian or school representative. Any download, access or use of the Service by anyone under eighteen (18) years of age is strictly prohibited and in violation of these Terms unless you are under the supervision of your school, school district, educational institution or Teacher (collectively referred to as “Schools”). If you are under eighteen (18) years of age, your use of the Service may be subject to additional policies and restrictions imposed by your School, with which you must comply.
User Content
We do not claim ownership of user-generated content and material.
Tracking Student Achievement
Student achievement and completion is tracked in the UEE learning platform. Teachers can monitor student progress and download their assignments if they choose. Students are not graded by UEÉ. Teachers may choose to utilize the rubric provided or evaluate students as they choose.
Our Proprietary Rights
Except for your User Content, the Service, and all materials therein or transferred thereby, including, without limitation, content, assignments, learning images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and instructions, and all Intellectual Property Rights related thereto, are the exclusive property of UEÉ and its licensors.
Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any UEÉ Content. Use of the UEÉ Content for any purpose not expressly permitted by these Terms is strictly prohibited.
For the purposes of these Terms, “Intellectual Property Rights” means all patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights and other intellectual property rights as may now exist or hereafter come into existence, and all applications therefore and registrations, renewals and extensions thereof, under the laws of any state, country, territory or other jurisdiction.
